Legal Agreement

Send The Car Terms and Conditions

These terms govern use of our website and reservations for Send The Car's chauffeured transportation services.

Effective date:1/1/2026

1. WHO WE ARE AND WHEN THESE TERMS APPLY

These terms are an agreement with Send The Car (“Send The Car,” “we,” “us,” or “our”), a prearranged chauffeur service serving Southwest Michigan. These terms govern use of our website and reservations for our chauffeured transportation services. “You” means the person making the reservation and, where applicable, the customer purchasing the service.

Customer service email: sendthecar.mi@gmail.com

Telephone: (616) 899-9332

Our separate Privacy Policy describes how we handle personal information.

By affirmatively accepting these terms when making a reservation, you agree to this agreement. If you do not agree, do not complete the reservation. Website access alone does not authorize us to charge you for transportation.

The person making a reservation must be at least 18 and authorized to enter into this agreement and use the payment method supplied.

2. SERVICES AND RESERVATION CONFIRMATION

We provide prearranged chauffeured transportation, including point-to-point trips, airport transportation, and hourly service where available. Service availability depends on the route, schedule, passenger count, vehicle capacity, and any special requests.

Stretch limousine service is arranged by telephone only. It cannot be reserved or paid for through the website; call (616) 899-9332 to book it.

A quote, website submission, or automated acknowledgment is not a confirmed reservation. A reservation is confirmed only when we send written confirmation and any required payment or deposit has been received. If we collect payment but cannot accept your request, we will refund it.

Your confirmation will identify the agreed pickup location, destination or itinerary, date, time, vehicle class, passenger capacity, price, payment schedule, and applicable cancellation and waiting terms. Review it promptly and contact us about errors.

Any special terms must be disclosed and accepted before confirmation. They control over these general terms only for the subjects they expressly address. Changes after confirmation require agreement by both parties.

3. MINIMUM ADVANCE NOTICE

Reservations require at least 48 hours of advance notice before the requested pickup time. Pickup times less than 48 hours away are unavailable for online booking. The website will display: “All drivers are booked for the next 48 hours.”

The 48-hour requirement is a minimum notice period and does not guarantee availability after that period. Reservation confirmation is still required. Times are interpreted in the pickup location’s local time zone unless the confirmation states otherwise.

4. CUSTOMER INFORMATION AND RESERVATIONS FOR OTHERS

Provide accurate pickup and destination addresses, contact information, passenger counts, luggage details, and any requested stops. For airport pickups, provide the airline, flight number, arrival date, and any material itinerary changes.

Tell us before booking about child restraints, mobility equipment, service animals, accessibility needs, unusually large luggage, or other requirements so we can discuss suitable arrangements.

You may reserve and pay for another passenger if you have permission to provide their information. You are responsible for the booking charges you agree to and for sharing the trip details and applicable passenger rules. Making a booking for someone else does not make you their legal agent for waiving personal injury or other individual rights.

5. PRICES AND INCLUDED SERVICES

Point-to-point prices cover the confirmed itinerary. Hourly service covers the confirmed reserved period, subject to the disclosed minimum and billing increments.

Hourly minimum: 3 hours.

Hourly service is reserved in whole hours, as shown in the accepted quote.

The quote and confirmation will identify what is included and any applicable taxes, tolls, parking, airport charges, waiting charges, additional stops, or other fees. Gratuity is included in the quoted fare; the price shown at booking is the total price for the confirmed itinerary. No separate gratuity or service charge is added unless it is disclosed and accepted in advance for a specific service, and any such charge will be identified accurately.

Online distance calculations, route maps, and travel times may be estimates. Before confirmation, we will disclose the final agreed price or the method for calculating variable charges. We will not change a confirmed fixed fare solely because we choose a different route.

Requested itinerary changes, extra stops, extended service, or additional waiting may incur charges at the rates accepted during booking. Where practicable, we will explain the added cost and obtain approval before providing additional service. Availability is not guaranteed.

6. PAYMENTS AND AUTHORIZED CHARGES

Accepted payment methods: credit and debit cards, processed through Square.

Deposit required: none. The full fare is charged when the reservation is made.

Remaining balance due: none — the fare is paid in full at booking.

Payments are processed by Square through its hosted checkout page; your card details are entered on Square's page, not stored on our website.

By accepting the displayed payment terms and supplying a payment method, you authorize the agreed reservation payment on the disclosed schedule. Any card authorization hold and its amount will be disclosed before it is placed. The release timing of a hold may depend on your financial institution.

Additional charges must be authorized by this agreement and the accepted booking terms or separately approved by you. We will provide an itemized explanation for additional charges. This provision is not unlimited authorization to charge a stored payment method.

If a required payment fails, we will attempt to contact you using the information supplied. If payment is not resolved by the stated deadline, we may cancel the reservation under the cancellation terms accepted at booking.

Contact us promptly about billing errors. Nothing in these terms limits your lawful payment-dispute or chargeback rights.

7. CUSTOMER CANCELLATIONS AND RESCHEDULING

The 48-hour advance booking requirement is separate from the cancellation policy.

For standard reservations, the following cancellation policy applies:

  • Cancellation received at least 24 hours before pickup: full refund of amounts paid.
  • Cancellation received less than 24 hours before pickup: no refund; the fare is charged in full.
  • No-show after the agreed waiting and contact procedure in Section 8: no refund; the fare is charged in full.

Any different policy for special events, extended trips, or other services must be disclosed and accepted before confirmation. Cancellation charges should reasonably reflect the reservation and expected loss; they are not intended as penalties.

Send cancellation and rescheduling requests to the email or telephone number listed in Section 1. A request takes effect when received through those channels; our acknowledgment confirms receipt but does not move the receipt time. Retain your message or other record.

Rescheduling depends on availability. Any fare difference or applicable cancellation charge will be explained before you accept the change.

Approved refunds will be initiated within 5 business days, ordinarily to the original payment method. Your financial institution may take additional time to post the refund.

8. PICKUP WAITING AND NO-SHOWS

Be ready at the confirmed pickup location and time. If you cannot locate your chauffeur, contact us before leaving the location.

Included waiting time for non-airport pickups: 15 minutes after the confirmed pickup time.

Included waiting time for airport pickups: 60 minutes starting from actual flight arrival.

Additional waiting rate: additional waiting is billed per hour at the reserved vehicle's hourly rate.

Before classifying a reservation as a no-show, we will wait the disclosed period (15 minutes for non-airport pickups; 60 minutes for airport pickups starting from actual flight arrival) and make reasonable attempts to contact the passenger or booking customer. Any no-show charge must be stated in the accepted reservation terms.

Where flight monitoring is offered, the confirmation will explain how arrival changes affect pickup time, included waiting, and availability. Tell us about flight changes; do not assume automatic monitoring or unlimited waiting.

9. TRAVEL TIMES DELAYS AND COMPANY CANCELLATIONS

Allow sufficient time for traffic, weather, airport procedures, baggage collection, security, and other foreseeable delays. We can help estimate travel time, but cannot guarantee arrival at an exact time.

We may delay, reroute, or cancel service when reasonably necessary because of unsafe conditions, road closures, vehicle failure, illness, or other circumstances affecting safe or lawful performance. We will make reasonable efforts to notify you promptly and discuss available alternatives.

We may propose a substitute vehicle of equivalent or better class and sufficient capacity. A materially different vehicle or third-party carrier requires your approval. If an acceptable substitute is unavailable, you may decline and receive a refund for the transportation we cannot provide.

If we cancel for reasons unrelated to your breach, we will refund amounts paid for unprovided service. We will not charge a customer cancellation fee for a cancellation we initiate for those reasons. These refund commitments do not eliminate other rights or remedies provided by law.

10. PASSENGER SAFETY AND CONDUCT

Passengers must follow lawful safety instructions and use available seat belts. We will not exceed the vehicle’s safe and lawful passenger or luggage capacity.

Smoking, vaping, illegal drug use, threats, harassment, violence, and conduct that endangers anyone are prohibited in our vehicles. Alcohol may be brought or consumed only if we expressly permit it and applicable law allows it. Underage drinking is prohibited.

Do not ask the chauffeur to speed, violate traffic laws, or make an unsafe stop. The chauffeur may select a route or pickup location reasonably necessary for safety or legal access.

We may refuse or end service for a material safety violation, unlawful activity, or threatening or abusive conduct. Where reasonably possible, the chauffeur will stop at a safe and lawful location. Any retained fare or additional charge must follow the disclosed booking terms and applicable law.

We do not refuse service on grounds prohibited by law. Service animals and disability-related requests will be handled in accordance with applicable law. Ordinary pet transportation requires advance approval.

Our service is not emergency medical transportation. Call 911 for a medical emergency.

11. CHILDREN AND CHILD RESTRAINTS

Tell us the number and ages of children traveling before confirmation. Appropriate child restraints must be arranged in advance and used whenever required by applicable law or the agreed safety requirements for the trip.

When child seats are requested during booking (for example, through the child-seats option on our booking form) and the reservation is confirmed, we will provide appropriate child restraints for the children traveling. If we are unable to provide an appropriate restraint for a child, we will tell you before confirmation so that you can supply a suitable restraint or adjust the reservation. We will not begin a trip when a required restraint is unavailable or cannot be used safely.

We do not transport unaccompanied minors unless a separate arrangement has been expressly agreed in writing and is legally permitted.

12. CLEANING DAMAGE AND PERSONAL PROPERTY

Ordinary cleaning is included. If a passenger causes damage or extraordinary cleaning needs, the responsible customer may be charged reasonable, documented repair or cleaning costs attributable to that conduct, subject to applicable law and the terms accepted at booking. Normal wear is excluded.

We will provide an itemized explanation and supporting documentation. No automatic flat cleaning or damage fee applies unless its amount and conditions were disclosed and accepted before booking.

Keep valuables with you and check the vehicle before leaving. Contact us promptly about lost property. We will make reasonable efforts to locate and arrange return of found items. Any shipping or delivery cost requires your agreement. Nothing in this section excuses loss caused by our negligence or limits rights that cannot lawfully be waived.

13. SERVICE MESSAGES AND MARKETING

We may contact you using the details provided to confirm reservations, coordinate pickup, report delays, send receipts, or address service issues. Supply a contact method that will be available around the trip.

Marketing communications are separate from essential reservation communications. Marketing texts or calls requiring consent will be sent only with the required consent, and consent is not a condition of purchasing transportation. You may unsubscribe from promotional email using the provided instructions and opt out of marketing texts through the stated method.

Standard carrier message and data rates may apply. If you stop text messages, contact us to arrange another way to receive necessary trip information.

14. PRIVACY AND THIRD-PARTY TOOLS

We handle personal information as described in our Privacy Policy. We may share information reasonably necessary to perform a reservation with assigned chauffeurs, approved transportation providers, payment processors, mapping providers, and other service providers, subject to applicable law and the Privacy Policy.

We may also disclose information when legally required. We do not promise absolute confidentiality or security.

Third-party payment, mapping, or other tools may have their own applicable terms and privacy policies. Maps and route estimates may contain errors. Links to outside websites do not constitute endorsement.

15. WEBSITE USE AND INTELLECTUAL PROPERTY

You may use the website to learn about our services, obtain quotes, and make lawful reservations. Do not submit fraudulent requests, misuse another person’s information, introduce malicious software, interfere with website security, or access restricted systems without authorization.

Website text, branding, photographs, and software are owned by us or used with permission, except where otherwise identified. You may view, print, or save information for personal use or legitimate business travel arrangements. Other reuse requires permission from the relevant rights holder, except as permitted by law.

Send intellectual-property concerns to the email in Section 1 with sufficient details to identify the material and your rights.

16. WEBSITE AVAILABILITY AND RESPONSIBILITY

We make reasonable efforts to keep website information accurate and services available. The website may contain errors or experience interruptions. If we identify a material quote or booking error before confirmation, we will explain it and ask you to accept the corrected terms or decline with a refund of any payment collected.

To the extent permitted by law, the website is provided “as is” and “as available.” This website disclaimer does not cancel our transportation obligations, express promises in a confirmed reservation, or warranties and rights that cannot lawfully be excluded.

We are not responsible for delays or failures to the extent caused by events beyond our reasonable control. We will take reasonable steps to reduce disruption. Section 9 still governs refunds for service we do not provide.

To the extent permitted by law, we exclude liability for indirect or consequential business losses, such as lost business opportunities, resulting from service disruption. This exclusion does not apply to personal injury or death, our negligence, gross negligence, intentional misconduct, fraud, or any liability that cannot lawfully be excluded. Nothing in these terms waives mandatory insurance benefits or statutory consumer rights.

You remain responsible, to the extent provided by law, for direct loss caused by your fraud, unlawful conduct, or intentional or negligent damage. You are not required by these terms to indemnify us for our own negligence or wrongdoing.

17. QUESTIONS COMPLAINTS AND DISPUTES

Contact us through Section 1 with your reservation reference, relevant dates, and a description of the issue. We will make reasonable efforts to investigate and resolve complaints. This informal process does not prevent you from seeking urgent relief, making a regulatory complaint, disputing a payment, or exercising legal rights within applicable deadlines.

Michigan law governs this agreement, without displacing mandatory protections that otherwise apply. Unless applicable law requires otherwise, litigation concerning this agreement may be brought in a state court of competent jurisdiction in Barry County, Michigan, or an appropriate federal court serving that location.

These terms do not require binding arbitration or waive the right to bring an otherwise lawful class action.

18. CHANGES AND GENERAL PROVISIONS

We may update these terms for future reservations by posting a revised effective date. Confirmed reservations remain subject to the version accepted at booking unless both parties agree to a change or applicable law requires otherwise.

This agreement, the accepted reservation confirmation, and any expressly accepted special terms form the agreement for the transportation reservation. The Privacy Policy separately explains our information practices.

If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision on one occasion does not waive future enforcement.

You may not transfer a reservation without our approval. We may transfer this agreement as part of a lawful business transfer only if your existing reservation rights are preserved. Assignment does not remove obligations or protections imposed by law.
